ValueCommerce Co., Ltd. (Head office: Chiyoda-ku, Tokyo; Representative Director, President and CEO: Jin Kagawa) conducted a workshop on Tuesday, November 21, 2023, in which it provided affiliate site operators with information regarding the Act against Unjustifiable Premiums and Misleading Representations (“Premiums and Representations Act”) and stealth marketing. Attorney Koya Uemura, advisor for the Tokyo Digital CATS (Clean Advertising Team of Specialists), an initiative by the Tokyo Metropolitan Government aimed at addressing issues involving improper online advertising representations, provided a detailed explanation of matters related to the Premiums and Representations Act.

In the first half of the workshop, Uemura provided an overview of the Premiums and Representations Act and discussed what led to the introduction of the new stealth marketing regulations.

In the second half of the workshop, he answered some of the most frequently asked questions from the pool of questions submitted in advance by workshop participants. He provided information and cautionary notes that all affiliate marketers must keep in mind with regard to how the law applies to their affiliate advertising activities.

In a questionnaire administered to workshop participants following the workshop, 95% of respondents replied that the workshop was “very informative/useful” or “informative/useful.” Many respondents said that they learned a lot from the workshop, with comments such as:

• • “I learned the differences between regulations regarding representations which exaggerate quality and regulations regarding stealth marketing.”
  • “There were aspects of the stealth marketing regulations that I didn’t understand before attending the workshop, and I’d been struggling with the decision of whether or not to continue my affiliate marketing activities, but the workshop showed me that what I actually needed to do was simple, which gave me a lot of peace of mind.”
